作为投资自由化的主要推动者,美国不遗余力地推行准入阶段的国民待遇。然而,事实却表明,在推行高度自由化投资规则的同时,美国设置了周密的例外安排,层层克减,将高标准的国民待遇义务降低至其可控范围之内。鉴于例外安排对缔约国,特别是发展中国家,施政空间的预留尤为关键,故中国在未来的缔约实践中,不应盲目地追求所谓的“全面国民待遇标准”,而应根据自身情况引入体系化的例外安排。
As the main advocate of investment liberalization, the United States has been spare no efforts in popularization of national treatment in the pre-establishment phase. However, the facts show that the United States lodge an elaborative reservation, when it devotes to high level investment liberalization rules, to step down the substantive treaty obligation of national treatment and put it under its control. In view of that the reservations in IIA are a key technique for preserving flexibility of national authorities, especially for developing countries. It is very important for China to introduce a systematical reservation rather than pursue the alleged “general national treatment standard” for foreign investment blindly.
