本文受2017年国家社科重大课题“构建中国特色境外追逃追赃国际合作法律机制研究”( 项目编号: 17ZDA136)2019年湖南省教育厅优秀青年课题“我国境外追逃追赃国际警务合作法律制度研究”( 项目编号: 19B182 )的资助。
开展境外追逃追赃的国际合作是最有效的打击跨国跨境犯罪、腐败犯罪的手段。我国先后加入了多个国际公约以更好地开展追逃追赃的国际合作,如《联合国反腐败公约》《联合国打击跨国有组织犯罪公约》;也与多个国家签订了相关的引渡条约与刑事司法协助协定。这些多边、双边条约为我国的境外追逃追赃国际合作提供了法律依据,但要在西方话语权占据主导地位的现有国际追逃追赃制度框架下完全实现自身诉求仍然存在一些困难。因此,必须结合现有的国际法框架,并结合我国具体国情,构建具有中国特色追逃追赃国际合作法律机制。我国可通过加强双边、多边条约的签署,与国际立法接轨,完善我国引渡制度,刑事司法协助制度,明确资产追回的主体,借鉴英美国家的民事没收制度与资产分享制度,在新出台《国际刑事司法协助法》的基础上进一步完善我国追逃追赃的国际合作制度。
The most effective means to combat transnational and corruption crimes is to cooperate internationallyin tracing fugitives and recovering stolen assets. In order to deploy cooperation better and make it legal, Chinahas acceded to several international conventions, such as the United Nations convention against corruptionand the United Nations convention against transnational organized crime. Relevant extradition treaties andagreements on criminal judicial assistance have also been signed with many countries. These multilateral andmultilateral treaties provide a legal basis for international cooperation in the pursuit of fugitives and assetsabroad, but there are still many problems. These problems are the legal obstacles for China to effectively carryout international cooperation in the pursuit of fugitives and assets. We can strengthen the signing of bilateral andmultilateral treaties. In line with international legislation, perfect our extradition system; Make clear the subjectof asset recovery and draw lessons from the civil confiscation system and asset sharing system in developedcountries. On the basis of the newly promulgated international criminal judicial assistance law, we will furtherimprove our international cooperation system of chasing fugitives and recovering stolen assets.
