WTO改革的“包容性”方案针对的是多边贸易体制的“普遍性”困境:在规则上,“市场化”标准难以形成普遍性共识;在体制上,特殊与差别待遇的存续与升级之争导致规则的普遍性适用分歧;在法理上,多元成员间的现实差异和为实现形式普遍性而内嵌的融合机制,导致了多边体制内生的“普遍性”悖论。该困境的溢出效应表现为多边体制外“市场化”规则的普遍性升级和泛区域小多边机制的普遍性效应。当前权力与规则双驱并行的国际造法现实,决定了多边体制改革的包容性进路,即在多元差异化主体间的最底线求同。中国应以包容的“多元共同体”为目标,重视小多边造法活动的普遍性辐射效应,主动提供区域治理公共产品,以有效引领普遍性困境的突破。
The “inclusiveness” formula for the WTO reform aims at the “universality” tangle of the multilateral trade mechanism: universal consensus on “market-oriented” standards is difficult to reach; dispute over maintaining and upgrading Special and Differential Treatment leads to the divergence of universal application of the rules; the realistic differences among multiple members and the embedded integration mechanism for the purpose of universality in its form lead to the endogenous “universality” paradox of multilateral system. The spillover effect of this predicament is manifested in the universally upgraded “market-oriented” rules outside the multilateral system and the universality effect of the trans-regional minilateral mechanism. The current international law-making reality of power and rule as dual drive, determines the inclusive approach for the multilateral system reform as seeking common baseline among multiple differentiated subjects. China should take inclusive “multivariate community” as goal, value the universally radiating effect of minilateral law-making activities, and actively provide public goods for regional governance, so as to effectively lead to break through the universality predicament.
