社会主义现代化建设引领区的立法定位兼具自贸试验区与自由贸易港的叠加效应,表现为“比照经济特区”的授权立法方式。因此,引领区的司法保障也应兼顾传承与创新两大方面,在秉持“法治化、市场化、国际化”基本理念的基础上,从四个方面实现保障路径的贯通:一是司法主动回应立法变动,填补引领区“立法真空”;二是准确定位政策功能,辩证把握引领区创新政策的司法运用;三是依法维护市场创新,贯彻司法对市场的谦抑原则;四是全面契合国际化需求,提升引领区司法的国际公信力。 上述举措的实现需要构建全新的支撑平台,故设立国际商事法院不仅符合引领区的政策定位,而且具备相当之必要性与可行性。国际商事法院在管辖围界方面需要充分考虑“放宽协议管辖”等改革方向,在审判规则创新方面则应全面对接商事领域的国际通行规则。
The legislative orientation of “the pioneer area for construction of socialist modernization” has the superposition effect of the free trade zone and the free trade port in China, it is manifested in the authorized legislative mode of “comparing with the special economic zone”. The judicial protection of the pioneer area should also take into account two aspects of inheritance and innovation. On the basis of the concept of “legalization, marketization and internationalization”, the future path comes from four aspects. Firstly, the court should actively response to legislative changes to fill the “legislative vacuum”. Secondly, the court should accurately dialectically grasp the judicial application of the innovation policy. Thirdly, the court should implement the principle of judicial humility to protect market innovation. Fourthly, the court should fully meet the needs of internationalization and enhance the international credibility. The realization of the above path needs to build a new support platform. Therefore, the establishment of the international commercial court is not only in line with the policy positioning of the pioneer area, but also has considerable necessity and feasibility. In terms of jurisdiction of the international commercial court, we need to fully consider the reform direction such as “relaxing the jurisdiction by agreement”, and in terms of the innovation of trial rules, we should fully connect with the international prevailing rules in the commercial fi eld.
