A well-framed national legislation serves as both the prerequisite for ensuring a sustainable development of DSM activities in the Area and the guarantee for the performance of obligations pertaining to those sponsoring states as proscribed in international law. Foreign legislations are featured by the implementation of direct obligation of environmental protection, the establishment of environmental funds and security deposit, the improvement of safety operation and emergency management mechanisms, the refinement of information disclosure and consultation mechanisms, the creation of personnel training and social welfare requirements as well as the harmonization of the rules and regulations of the International Seabed Authority by proscribing supplementary rules, which provide useful extraterritorial experience pertaining to DSM legislation. In view of this, DSM legislation in China should adhere to principles of environmental protection, optimization of services and maximization of economic and social benefits, formulating operational rules to fulfill direct obligation of environmental protection, establishing a robust financial system with regard to environmental protection, clarifying the responsibilities of administrative departments for the safety and emergency handling of activities in the Area, refining the mechanism for the protection of rights of marine scientific research and the operation of public platform for the DSM activities. Meanwhile, China should take steps for updating its legislation so as to leave enough space for the further development of DSM laws and relevant international rules.
