为追求利润最大化,平台通过弱化“网约工”的主体适格性、组织从属性及淡化自身劳动管理职能的方式掀起了“去劳动关系化”的浪潮。通过比较劳动关系“二分法”和“三分法”,以及探讨劳动关系从属性的法理基础可知,“网约工”与传统劳动者的形成路径并无实质区别。传统劳动关系构成要件在法律适用过程中应当遵循事实优先原则,聚焦指示权和惩戒权的认定以及平台经营业务的实质范围。本文旨在通过对劳动关系构成要件的因应提升其适用性,同时为搭建《劳动法》与《反不正当竞争法》《反垄断法》 对平台用工的综合治理桥梁提供理论铺垫。
In the pursuit of profit maximization, platforms have started a wave of “de-laborization” by weakening the subject suitability and organizational subordination of “online workers” and diluting their own labor management functions. A comparison of the dichotomous and trichotomous approaches to labor relations and an exploration of the jurisprudential basis for the subordination of labor relations reveals that there is no substantial difference between the path of formation of “online workers” and traditional workers. The application of the law on the constituent elements of traditional labor relations should follow the principle of factual priority, focusing on the determination of the right to instruct and discipline and the substantive scope of the business operated by the platform. The article aims to enhance the applicability of the constitutive elements of labor relations through their causal application. At the same time, it provides a theoretical basis for building a comprehensive management bridge between labor law, anti-unfair competition law and anti-monopoly law on platform employment.
