因《联合国海洋法公约》的出台及国际社会在海洋法层面实践活动的不断丰富,越来越多的双边投资协定通过“领土定义条款”的形式将领土以外的水域纳入适用范围。 但因双边投资协定碎片化的特征,不同双边投资协定的领土定义条款存在显著差异。 此外,国家在不同水域所享有的主权性权利、管辖权的类型和范围亦有较大差异,使得特定双边投资协定能否在专属经济区、大陆架、公海、国际海底区域、其他国家管辖水域等非领土水域的适用,以及能够对哪些具体的涉海投资实现保障都需要单独加以判断。作为国际投资领域和海洋法领域具有广泛影响力的大国,中国应重视双边投资协定和海洋法之间的联动关系,以两者之间的互动为契机,尽快使更多双边投资协定能够实现在非领土水域的适用,并通过海洋法实践进一步扩大双边投资协定的适用范围,从而追求涉海投资保障以及有效参与全球海洋治理目标的共同实现。
Due to the impact of the United Nations Convention on the Law of the Sea and other international practices in the law of the sea, an increasing number of Bilateral Investment Treaties (BIT) are incorporating “territorial defi nition clauses”to include water areas beyond a country’s territory in their scope of application. However, due to the fragmented nature of BIT, significant differences often exist in the territorial definition clauses of different BIT. Furthermore, there are substantial variations in the types and extent of sovereign rights and jurisdiction that states enjoy in different maritime zones, such as exclusive economic zones, continental shelves, high seas, regional waters, and other waters under national jurisdiction. This makes it necessary to assess on a case-by-case basis whether specifi c BIT are applicable in non-territorial waters and which specifi c maritime investments can be safeguarded. As a major player with signifi cant infl uence in both the international investment and the law of the sea domains, China should focus on the interconnected relationship between BIT and the law of the sea. Seizing the opportunity of their interaction, China should expedite the adaptation of more BIT for application in non-territorial waters and further expand the scope of BIT through the law of the sea practices. This pursuit aims to achieve common goals of safeguarding maritime investments and effectively participating in global ocean governance objectives.
