透明度原则具有发现、识别和规避危害性补贴的作用。国际高标准经贸协定较为普遍地对补贴的透明度作出了规定,呈现出拓展成员方的补贴通报范围、增加有关补贴损害的救济程序、纳入促进补贴通报的遵约措施等发展趋势。出现这一趋势背后的直接原因在于 WTO 补贴透明度原则的实践状况不佳,根本原因则在于由发达国家推动的国际贸易规则的“公平贸易”转向。面对高标准国际经贸协定中补贴透明度原则不断强化的趋势,我国补贴政策的透明度总体不足,应当加强对透明度义务与国家安全问题的统筹,努力改进通报义务履行状况,建立有效及时的信息公开平台,推进政府实施补贴与企业接受补贴情况的公开。在国际层面,我国应当提出“共同但有区别”的补贴改革方案,强调关注发展中国家的能力建设,鼓励各国结合本国国情进行政策实践,避免对成员方延迟通报采取惩罚性措施。
The principle of transparency plays a role in discovering, identifying, and avoiding harmful subsidies. International high-standard economic and trade agreements generally stipulate the transparency of subsidies, showing a trend of expanding the scope of subsidy notifications by member countries, increasing relief procedures for subsidy-related damages, and incorporating compliance measures to promote subsidy notifications. The direct motivation behind this is the poor implementation of the WTO principle of subsidy transparency, while the fundamental motivation lies in the overall shift of developed countries towards promoting “fair trade” in international trade rules. Faced with the trend of increasingly stringent subsidy transparency principles in high-standard international economic and trade agreements, China’s subsidy policies are generally insuffi cient in terms of transparency. Therefore, on the basis of strengthening the coordination of transparency obligations and national security issues, and improving the fulfi llment of notifi cation obligations, China should construct an eff ective and timely information disclosure platform to promote the transparency of government subsidy implementation and enterprise subsidy acceptance. At the international level, China should propose a “common but diff erentiated” subsidy reform plan, emphasizing the focus on capacity building in developing countries, encouraging countries to practice policies in accordance with their national conditions, and avoiding punitive measures for delayed notifi cations by member countries.
