人工智能作为驱动新一轮科技革命和产业变革的核心力量,其高质量发展深度依赖数据、算法、算力三大核心要素的协同创新。然而,人工智能技术创新过程中衍生的数据垄断、算法共谋、算力配置失衡等竞争风险,对传统竞争治理体系构成系统性挑战。立足“十五五”规划中我国“深化拓展 ‘人工智能 +’战略,赋能经济社会发展和治理能力提升”的发展目标,聚焦人工智能在数据、算法、 算力维度的竞争风险表现与生成机理,在系统性革新现行市场竞争法治的基础上,通过常态化、精细化的竞争治理,推动人工智能创新发展中制度革新与技术创新的良性互动,即制度革新为技术创新释放应用空间,技术创新又进一步推进制度革新,两者形成正反馈循环。基于此,为健康、有序、 普惠的人工智能创新发展提供制度支撑和技术支持。
As a core driving force behind the new round of technological revolution and industrial transformation, the high-quality development of artifi cial intelligence deeply relies on the collaborative innovation of three key elements: data, algorithms, and computing power. However, competitive risks arising from AI technological innovation, such as data monopolies, algorithmic collusion, and imbalanced computing power allocation, pose systemic challenges to traditional competition governance systems. Building on the development goals in China’s 15th Five-Year Plan to deepen and expand the ‘AI+’ strategy for empowering economic and social development and enhancing governance capacity, this study focuses on the manifestations and mechanisms of competitive risks in AI across the dimensions of data, algorithms, and computing power. By systematically reforming the current legal framework for market competition, it promotes the positive interaction between institutional innovation and technological advancement in AI development. Specifically, institutional reforms create the application space for technological innovation, while technological advancements further drive institutional reforms, forming a positive feedback loop. This approach provides institutional and technical support for healthy, orderly, and inclusive AI innovation and development.
