开源生态系统是以聚合经营为核心的商业模式,其以被聚合产品与服务的互补性为主要运行特征。其市场力量不仅表现为单一产品市场中的高份额或高价格,还通过互补关系形成跨市场的传导效应,这对基于替代性的传统相关市场的分析范式构成了挑战。对此,有必要引入跨市场传导机制的分析框架,揭示互补关系从策略性扭曲到定向化传导,最终固化为私益治理规则的作用路径。具体而言,开源生态经营者可通过搭售形成节点间的双向互补,通过限定交易控制连接杠杆,将竞争损害从流通环节前移至生成阶段,进而通过生态治理规则,将互补关系固化为封闭式垄断结构。鉴于竞争损害兼具正向市场力量扩散与反向生态锁定两个维度,反垄断法应突破以交叉价格弹性为中心的替代性分析框架,引入包含分流比、相对价值和非价格损害因素的修正GUPP I指标,以识别跨市场传导机制的竞争损害,并将规制重点从形式开源转向实质性开源,推动公平竞争秩序与可持续创新生态的协同构建。
The open-source ecosystem relies on aggregation as a core business model, with complementarities among aggregated products and services constituting a central operational feature. Market power in such ecosystems may not manifest itself through high market shares or elevated prices within a single product market. Rather, it may operate through complementary relationships and generate cross-market transmission effects, thereby challenging traditional relevant-market analysis centered on substitutability. Addressing this challenge requires an analytical framework capable of identifying how market power is transmitted across complementary markets and how such relationships may evolve from strategic distortion, to directed transmission, and ultimately to their institutionalization in governance rules that serve private interests. Specifically, operators of open-source ecosystems may create bidirectional complementarity among nodes through tying, control connection leverage through exclusive dealing, and shift competitive harm from the distribution stage to the development stage. These practices may subsequently be entrenched through ecosystem governance rules, giving rise to a closed and potentially monopolistic structure. Because competitive harm in open-source ecosystems may result both from the forward transmission of market power and from reverse ecosystem lock-in, antitrust analysis should move beyond a substitutability-based framework focused primarily on cross-price elasticity. It should instead consider a modified GUP PI-type metric incorporating diversion ratios, relative value, and non-price harm variables in order to assess the intensity of cross-market transmission and the strength of exclusionary incentives. Such an approach would redirect regulatory attention from formal openness to substantive openness and support the coordinated development of effective competition and sustainable innovation within open-source ecosystems.
